School sits on former open space that activists want back — eventually

Inter-Neighborhood Cooperation Posted on September 6, 2015 by MaggieFebruary 20, 2017

Two years after the Denver City Council cleared the way for a controversial land swap, children filed last month into a new elementary school built on former city-owned open space near Cherry Creek Reservoir.

But the Joe Shoemaker School’s opening hasn’t ended a legal fight by still-simmering Denver parks advocates over what they saw as an illegal giveaway of valuable park land, a charge disputed by city officials.

RESOLUTION on DESIGNATING DENVER’S PARKS- Delegation Vote to Support at AUG 8th Meeting

Inter-Neighborhood Cooperation Posted on July 30, 2015 by MaggieAugust 5, 2015

Allocate additional funding to Denver Parks and Recreation for more staff and resources in order to complete the park designation process by the end of 2017. Prioritize the next phase of the park designation process to focus on gulches, drainage ways, and other areas of the City that provide trail and greenway connections to large geographic areas. This would include Weir Gulch Park, Sanderson Gulch Park, Harvard Gulch Park, and parks along the South Platte River and Westerly Creek.

On Feb 4, 2015 Attorney John Case filed on behalf of Friends Of Denver Parks, a brief with the Colorado Court Of Appeals. Friends of Denver Parks was the recipient of the 2014 INC Presidents Award

Please see the letter from John Case

ATTACHMENT

Dear Friends,

Thank you for your continuing support of Friends of Denver Parks and efforts to protect open space in Denver.

Attached is a copy of the brief that Evans Case LLP filed for plaintiffs-appellants in the Colorado Court of Appeals on February 4, 2015. We are asking the court to reverse the decision of Judge Stern so that, in accordance with Charter Section 2.4.5, the people of Denver may vote on the issue of whether 11 acres of park land should be traded to DPS for use as a school. We filed a lis pendens on the property in 2013 before the City conveyed it to DPS, so our interests are protected until all appeals are exhausted.
